Go Viral is a multi-platform video distribution service that lets creators upload a video once and publish it to YouTube and YouTube Shorts, TikTok, Instagram, and other platforms as they become available (the "Service"). The Service is operated from Bolton, England.
These Terms of Service ("Terms") form a binding agreement between you and Go Viral ("we", "us", "our"). By creating an account, checking "I agree to the Terms" at sign-up, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf, and "you" refers to that organization.
2. User Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Service.
You must provide accurate, current, and complete information when registering and keep it up to date.
You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
You may not share your login credentials, sell or transfer your account, or use another person's account without permission.
You must notify us promptly at jack.willo1122@gmail.com of any unauthorized use or suspected security breach.
We authenticate accounts and may offer sign-in through connected social platforms. You are responsible for the security of any third-party account you use to access the Service.
3. Subscriptions & Billing
The Service is offered on recurring monthly subscription plans. Current plans and their limits are:
Starter — £19/month: up to 5 videos per month across 3 platforms.
Creator — £49/month: up to 25 videos per month across 8 platforms.
Agency — £149/month: unlimited videos across up to 10 workspaces.
Prices are in pounds sterling (GBP) and, where applicable, exclusive of VAT or other taxes, which will be added at checkout. We may change plan pricing or features on notice; changes take effect at the start of your next billing cycle.
Payment processor. Payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel. Your use of Stripe is subject to Stripe's terms.
Auto-renewal. Subscriptions renew automatically each month at the then-current price unless cancelled before the renewal date.
Cancellation. You may cancel at any time from your billing settings. Cancellation stops future renewals; access continues until the end of the paid period.
Failed payments. If a payment fails, we may retry the charge and mark your account "past due". We may suspend or downgrade access until payment succeeds.
Refunds. Except where required by law, subscription fees are non-refundable, and we do not provide refunds or credits for partial billing periods, unused videos, or downgrades. If you believe you were charged in error, contact us at jack.willo1122@gmail.com.
Free trials. Any free trial, if offered, converts to a paid subscription at the end of the trial period unless cancelled beforehand.
4. User Content & Rights
"User Content" means the videos, captions, hashtags, thumbnails, and other material you upload to or generate through the Service.
You retain all ownership of your User Content.
You grant Go Viral a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transcode, reproduce, adapt (for formatting), and transmit your User Content solely to operate and provide the Service — including publishing it to the platforms you connect on your instruction. This license ends when you delete the content or your account, except for content already published to third-party platforms and for backups retained for a limited period.
You represent and warrant that you own or have all rights, licenses, and permissions necessary to your User Content and to grant the license above.
You represent that your User Content, and its distribution through the Service, does not infringe any intellectual property, privacy, publicity, or other rights, and complies with all applicable laws.
You are solely responsible for your User Content and for keeping your own backups. We do not guarantee that content stored on the Service will be retained, and you should not rely on the Service as your only copy.
5. Social Platform Posting
The Service publishes your videos to third-party platforms (such as YouTube, TikTok, and Instagram) using access you authorize through their official connections.
Your use of each platform is governed by that platform's own terms, community guidelines, and policies, which apply to you separately and in addition to these Terms. You are responsible for reading and complying with them.
You are responsible for ensuring your content meets each platform's format, length, and content requirements, and for holding the rights required to post there.
Platforms may reject, remove, restrict, demonetize, or delay content, may rate-limit or revoke API access, and may suspend accounts, for reasons outside our control. We are not responsible or liable for any platform's actions, availability, or decisions.
You may disconnect a platform at any time. Revoking access may prevent us from publishing or retrieving analytics for that platform.
We do not guarantee that any post will be published, remain published, reach any audience, or achieve any level of performance.
6. Acceptable Use Policy
You agree not to use the Service, and not to upload or distribute through it, any content or conduct that:
Is illegal or promotes, facilitates, or instructs others in illegal activity;
Is hateful, discriminatory, harassing, defamatory, threatening, or abusive;
Is spam, deceptive, fraudulent, or manipulates platform metrics through artificial or automated means;
Infringes copyright, trademark, or other intellectual property rights;
Contains malware, viruses, or other harmful code, or attempts to gain unauthorized access to systems or data;
Sexualizes minors, depicts child sexual abuse material, or involves underage individuals in adult content;
Violates the privacy or publicity rights of others, or discloses personal information without consent;
Attempts to reverse-engineer, scrape, overload, disrupt, or circumvent the Service, its rate limits, or its security.
We may investigate suspected violations and may remove content, and suspend or terminate accounts, that we reasonably believe violate this policy or these Terms.
7. Intellectual Property
Go Viral owns all intellectual property rights in the Service, including its software, design, user interface, text, graphics, logos, and trademarks. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
You retain ownership of your User Content, as described above. Nothing in these Terms transfers ownership of your content to us or of our platform to you.
"Go Viral" and our logos are our trademarks. You may not use them without our prior written permission.
Copyright / DMCA. We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to jack.willo1122@gmail.com identifying the work, the infringing material and its location, your contact details, and a statement of good-faith belief and accuracy. We may remove infringing content and terminate repeat infringers.
8. Limitation of Liability
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free, or that any publishing, analytics, or third-party integration will always function.
We are not liable for the acts, failures, downtime, or decisions of third-party platforms or payment processors, or for loss of data where you have not kept your own backups.
To the maximum extent permitted by law, Go Viral will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
9. Indemnification
You agree to indemnify, defend, and hold harmless Go Viral and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms or of any law; or (d) your violation of any third-party right, including any platform's terms or any intellectual property or privacy right.
10. Data & Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. Key points:
GDPR / UK GDPR. We process personal data in accordance with the UK GDPR and, where applicable, the EU GDPR. You have rights of access, rectification, erasure, restriction, portability, and objection, which you can exercise by contacting us.
Data storage. Account and content data is stored using Supabase (PostgreSQL). Transactional emails are sent using Resend. Payments are handled by Stripe. These providers process data on our behalf under appropriate safeguards.
Retention & deletion. You can delete your account at any time. On deletion, we remove your personal data within 30 days, except where we are required to retain it by law (for example, financial records).
Cookies. We use cookies and similar technologies for authentication and to operate the Service. See the Privacy Policy for details.
11. Termination of Service
You may cancel your subscription and delete your account at any time from your account settings.
We may suspend or terminate your access, with or without notice, if you breach these Terms, use the Service unlawfully, create risk or legal exposure for us, or fail to pay fees due.
We may also discontinue the Service, or any part of it, with reasonable notice where practicable.
On termination, your right to use the Service ends. Sections that by their nature should survive — including content licenses already exercised, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — continue to apply.
Following account deletion, your data is removed within 30 days, except where we are required to retain it by law. Content already published to third-party platforms remains subject to those platforms.
12. Dispute Resolution & Governing Law
These Terms and any dispute or claim arising out of or in connection with them or the Service are governed by the laws of England and Wales, without regard to conflict-of-law rules.
The courts of England and Wales have exclusive jurisdiction to settle any such dispute, except that if you are a consumer resident elsewhere in the UK, you may also bring proceedings in your local courts. Nothing in this section affects your statutory rights as a consumer.
Before starting formal proceedings, we encourage you to contact us at jack.willo1122@gmail.com so we can try to resolve the matter informally.
13. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last updated" date above. We may record the version of the Terms you accepted and the date of acceptance. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Service and may cancel your account.
